Liability Waiver & Release
Last updated: July 25, 2026
Every family must have a signed waiver on file before entering the studio. Please read this carefully — by signing, you are giving up important legal rights. If you have questions, ask a staff member before signing.
Notice: This document is a summary of the waiver you will sign in person or online before your first visit. It is not a substitute for the signed agreement.
1. Assumption of risk
I understand that creative play — including painting, water play, sand, clay, climbing on soft structures, building with blocks and LEGOS, and use of art tools and materials — involves inherent risks. These risks include, without limitation: slips, trips, and falls; bumps and bruises; skin, eye, or clothing contact with paint and other art materials; allergic reactions; exposure to common illnesses; and contact with other children and adults. I voluntarily accept and assume all such risks, known and unknown, for myself and my child(ren).
2. Parent / guardian presence
I confirm that I am the parent or legal guardian of the child(ren) attending, or that I am an authorized adult (18+) accompanying them with the guardian's written permission. I will remain with my child(ren) at all times inside the studio. I understand Fun Together is not a licensed childcare facility and does not accept drop-offs.
3. Health representations
- My child(ren) and I are in good health and physically able to participate.
- No one in my party has had a fever, vomiting, diarrhea, or a communicable illness in the last 24 hours.
- I have disclosed any allergies, medical conditions, or accessibility needs relevant to the visit.
4. Release and waiver
In consideration of being permitted to enter the studio and participate in activities, I, on behalf of myself, my child(ren), and my heirs, executors, and assigns, hereby release, waive, and forever discharge Fun Together LLC, its owners, officers, employees, contractors, volunteers, landlords, and agents (the "Released Parties") from any and all claims, demands, actions, or causes of action, whether known or unknown, arising out of or related to any loss, damage, injury, illness, or death that may be sustained during or as a result of participation, except to the extent caused by the Released Parties' gross negligence or willful misconduct, or as otherwise prohibited by California law.
5. Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claim brought by me, my child(ren), or any third party arising out of my or my child(ren)'s participation, to the extent permitted by law.
6. Medical authorization
In the event of an injury or medical emergency, I authorize Fun Together staff to seek and consent to reasonable emergency medical treatment for my child. I understand I am financially responsible for any medical care provided.
7. Photo release (optional)
Photo release is opt-in. You may choose whether to allow Fun Together to use identifiable images of your child in marketing. Your choice does not affect your ability to visit.
8. Governing law
This waiver is governed by California law. If any provision is held unenforceable, the remaining provisions remain in full force and effect. Venue for any dispute is Orange County, California.
9. Acknowledgment
I have read this waiver, I understand it, and I sign it voluntarily. I understand that by signing I am giving up substantial legal rights, including the right to sue the Released Parties for ordinary negligence.
